UN Secretary-General Invokes Article 99 Amid Gaza’s Escalating Humanitarian Crisis

In an unprecedented action that underscores the severity of the ongoing humanitarian crisis in Gaza, UN Secretary General António Guterres invoked Article 99 of the UN Charter recently. He did so in response to escalating concerns over the deteriorating conditions amid the ongoing Israel-Hamas war. As reported by JURIST, Guterres used this unique power due to the collapsing healthcare system in Gaza, partially attributing the devastation to Israeli bombings on hospitals in the region.

For context, Article 99 empowers the Secretary-General to alert the Security Council about any matter that could potentially threaten international peace and security. Notably, the previous use of this article dates back to 1989 during the Lebanese civil war.

In his communication, disseminated across various social media platforms, Guterres elaborated on the dire situation. He emphasized the “severe risk of collapse of the humanitarian system” in Gaza. Despite international efforts, humanitarian aid convoys have been unable to deliver essential supplies like food, water, and fuel due to the continuous fighting. Guterres’ appeal implored international institutions to assist in bringing this conflict to an end. He also voiced his support for the resumption of the humanitarian ceasefire that took place the previous month.

The situation is further complicated by recent reports from the Israel Defense Force (IDF) of missile launches from Lebanon into Israel and neutralization of a Hamas terrorist cell located in Khan Yunis tunnel systems. On the other side, the Palestinian Ministry of Health spokesperson has claimed that the “Israeli occupation intends to clear the health presence of northern Gaza”. There is severe pressure on the local hospitals such as the Baptist Hospital in Gaza, which struggle with limited operational capacities due to the high number of wounded people.

The grim outcome of the war, since October 7, as per records from the MOH is over 15,000 deceased Palestinians, including 6,000 children. The number of Israeli casualties since the escalation in October is around 1,200, according to IDF reports. The unprecedented invocation of Article 99 by Guterres accentuates the critical need for sustained, powerful international efforts towards resolving this longstanding crisis.
