Conservative Activist Edward Blum’s Unfinished Battle Against Law Firm Diversity Policies

Edward Blum, an influential conservative legal activist known for his successful fights against affirmative action in college admissions, may not be finished with his legal pursuits against law firms. Earlier this year, he instigated changes that led law firms to open diversity fellowships to all applicants.

An unexpected development arrived when Blum withdrew a lawsuit against law firm Winston & Strawn, resulting in media reports suggesting he had ended his legal battles. However, as Blum clarified in a recent interview with The American Lawyer, his statement was not meant to imply a permanent halt to his controversial legal pursuits.

“If we learn of a law firm that has a policy similar to the ones we sued and they have not changed it, and a plaintiff wants to apply for that position who is disqualified because of their race, we will file a lawsuit against that law firm,” Blum asserted. This suggests that his battle against what he perceives as racial bias in law firms might just be entering another phase.

Blum’s actions have provoked a vibrant debate in the legal profession, which continues to grapple with how to foster equitable representation. His advocacy for “colorblind” policies have compounded these discussions, raising questions about the best way forward for diversity initiatives within law firms.
