NYC and Oregon Pension Funds Lead Litigation Against Fox Directors in Defamation Case

The litigation against the directors of Fox News, which stems from decisions leading to a $787.5 million defamation settlement with Dominion Voting Systems Inc, is set to be overseen by a legal team representing the pension funds of New York City and Oregon public workers. This was the ruling delivered by the Delaware Court of Chancery on Friday.

The legal coalition, comprising of the litigation boutique Friedlander & Gorris PA, Cohen Milstein Sellers & Toll PLLC, and Lieff Cabraser Heimann & Bernstein LLP faced fierce competition from another group of pension and investment funds. The latter was represented by Robbins Geller Rudman & Dowd LLP, Bernstein Litowitz Berger & Grossmann LLP, and Kessler Topaz Meltzer & Check LLP.

The leadership prowess and wealth of experience owned by the NYC fund gave their team an edge. The involvement of public officials is a plus especially when intense media scrutiny is inevitable, which is often the case with high-profile litigations like this.

This move by the Delaware Court of Chancery showcases the growing trend of the courts taking into considerations the litigation expertise and leadership structures of legal teams when disputes involve large public sector entities like pension funds.
