Jury Examines Internal Emails in Davis Polk Retaliation Trial

The affair of an ongoing retaliation trial faced by reputed firm, Davis Polk & Wardwell, progressed recently as jurors examined the firm’s internal emails, including correspondence among Davis Polk attorneys and employees, and reactions to messages from the plaintiff.

At the center of the case is former associate Kaloma Cardwell, the sole Black male recruited in the 2014 associate class of Davis Polk, who left the firm in 2018 and subsequently filed a lawsuit the next year.

Among the email exchanges the jury were granted access to, were discussions around a “Black Affinity Group” event and another that threw light on the purported “social awkwardness” of lawyers. This glimpse into internal communications could significantly aid in piecing together the various elements that led to this lawsuit.
