Supreme Court Deliberates Texas Landowners’ Right to Sue Over Highway Project Damage

The United States Supreme Court recently struggled with determining whether or not Texas landowners have the constitutional right to sue the state for compensation following damage to their properties stemming from a highway project. This case engaged more than 70 landowners who claim that their properties were flooded due to the project.

Central to this dispute is the interpretation and application of the Fifth Amendment’s Takings Clause, which discusses a citizen’s legal right to seek compensation when their private property is occupied by the government for public use. The ongoing deliberations saw justices, including Chief Justice John Roberts, tackling with the question of whether the impacted property owners could rightfully seek payment for the damages via state court under state law.

Texas Solicitor General, Aaron Nielson, was among those involved in the discussions regarding the right to seek judicial review. This case would set a legal precedent impacting future disputes regarding property rights and the state’s responsibilities.
