Chief Judge Colm F. Connolly of the US District Court for the District of Delaware has been in the news recently for defending his jurisdiction to compel live testimony from Lori LaPray, owner of Backertop Licensing LLC.
Backertop Licensing LLC and LaPray have garnered public attention for their association with the patent monetization firm, IP Edge LLC. The owner of Backertop challenged Judge Connolly’s subpoena authority, arguing that the demand for her to fly from Texas to Delaware to deliver evidence contradicted civil procedure rules.
In response to this, Judge Connolly filed an amicus brief on Tuesday with the US Court of Appeals for the Federal Circuit, stating that his inherent power affords him the right to compel testimony.
