When the Supreme Court axed affirmative action in SFFA v. Harvard, the implications for the law school admissions process were inevitable. The widespread ramifications have been arduously managed by admissions officers navigating the admissions landscape minus a critical tool that promoted diversity; the process has undoubtedly proved challenging.
According to the experts at Kaplan, a survey conducted among law school admissions officers at 85 law schools reveals troubling trends occurring at ground zero—the admissions departments. The survey paints a less-than-optimistic picture. About 87 percent of the individuals surveyed expressed either somewhat or very substantial concerns about the potential impact on diversity in law schools nationwide. Alarmingly, approximately 59 percent expressed similar concerns about their particular school’s capacity to cultivate a racially diverse student cohort.
Law schools have always prioritized having diverse campuses, and the recent Supreme Court ruling on affirmative action has undeniably added to their manifold concerns. Amit Schlesinger, Kaplan’s Executive Director of Legal and Government Programs, spoke on the survey’s results. He emphasised that the recently observed trend of an increasingly diverse applicant pool may offer silver lining amidst these concerns. This trend could potentially mitigate challenges that may arise in achieving a representative student body. He also pointed out that some law schools have expanded their personal statement criteria. This move can allow admissions officers to gain better insights into the backgrounds of prospective students, thereby staying within the confines of the Court’s directive.
Despite 2023 witnessing the most diverse class that law schools have ever seen, Schlesinger maintains that this trend is unlikely to continue given the Court’s decision. However, law schools will likely continue their efforts to uphold diversity to the best extent they can, while abiding by the legal ruling.
