California IP Law Firm Sues for Alleged Unauthorized Use of “Sierra” Service Mark

The intellectual property (IP) law firm Sierra IP Law PC has launched a legal complaint against a Fresno, California-based personal injury law firm. According to Sierra IP Law, the latter is allegedly using its “Sierra” service mark without the necessary permission to offer legal services. These allegations, worth noting, refer specifically to practices related to advertisement and offerings of the disputed services through the personal injury outfit’s website and other medium.

Sierra IP Law has initiated its suit against John Michael Miser, who is associated with Sierra Litigation. The docket reveals that Sierra IP Law filed charges of infringement once they discovered Miser’s alleged unauthorized use of its registered “Sierra” mark. The case is currently being heard in the E.D. Cal. court.

The firm alleges that they first became aware of the perceived infringement sometime around February 2021. At that time, Miser was promptly informed about the violations pertaining to the use of the “Sierra” mark. However, despite their attempts at resolution, Sierra IP Law claims that no agreeable solution has been brought forth, thus prompting the need for legal actions.

Nevertheless, the full details of the dispute are yet to unfold and with the case remaining open, it may set a novel direction for similar IP disputes in the legal arena.
