Johnson & Johnson Faces Wave of Lawsuits Over Decongestant Efficacy Claims

Legal professionals are witnessing a wave of lawsuits aimed at healthcare giant Johnson & Johnson over their decongestant product. At the center of the litigation storm is the active ingredient, phenylephrine, used in many of their over-the-counter (OTC) decongestant products.

What’s particularly interesting is the fact that the U.S. Food and Drug Administration (FDA) released a report on September 12, 2023, examining the effects of phenylephrine. The report concluded that while there were no safety issues with using phenylephrine as a decongestant, it also found no significant health benefits.

Despite the FDA’s assertion of no safety issues, Johnson & Johnson finds itself under legal scrutiny. The lawsuits contend that Johnson & Johnson’s marketing of its decongestants are misleading, given the FDA’s assertion of no proven benefits.

These lawsuits are symptomatic of a wider trend concerning transparency in the healthcare industry, where alleged deceptive marketing practices are being challenged in courts across the U.S.
