Delays in D.C. Circuit’s Ruling Raise Concerns in Trump Election Interference Case

Concerns are increasing due to continuous delays in the D.C. Circuit’s ruling in the election interference case against Donald Trump. Despite the case being heard in early January, there has been no judgement served till date. The delay in the underlying trial’s commencement has provided a significant advantage to the former president. There’s a potential risk where, if the trial is not concluded by the time of the election and Trump gains a victory, he could pardon himself or instruct the Department of Justice to drop the case.

The seriousness of the situation has been emphasized by Neal Katyal, former acting Solicitor General and present partner of Hogan Lovells. During an appearance on MSNBC’s show, Jen Psaki, Katyal expressed his increasing concern, terming it a time to be in “freakout” mode. He cited the maxim ‘justice delayed is justice denied’, expressing the necessity for American citizens to be aware, prior to the election, if a candidate for office holds a criminal record. In Echoing Katyal’s sentiment, Andrew Weissmann, former federal prosecutor and NYU Law professor, also expressed his “violent agreement” with the notion.Full discussion can be found here.
