The procedure of sterilization, which involves surgically removing one’s reproductive capacity, used to be a requirement for transgender individuals wishing to legally change their gender in Japan. This process was considered highly controversial among human rights activists, as by making it a legal requirement, the state left little choice for transgender individuals, presenting a conundrum between undergoing surgery or achieving legal recognition of their self-identified gender.
In a landmark verdict in 2023, Japan’s Supreme Court declared this sterilization requirement unconstitutional. Transgender individuals, therefore, in theory, no longer needed to undergo this invasive procedure to have their gender legally recognized.
