The United States District Judge Richard Gergel has approved a $1.1 billion settlement in regards to the DuPont PFAS water contamination lawsuit. The judge deemed the settlement agreement to be reasonable, despite the understanding that the defendants accounted only for three to seven percent of the total alleged PFAS-related liabilities within the MDL defendants’ scope.
As the litigation, which promised to be protracted, complex and costly, unfolded against the defendants, it was apparent that a victory was uncertain and even if achieved, would not be immediate. Thus, the settlement serves to bring a more immediate resolution to an arduous legal battle. It also reveals the complexity and difficulty of contesting cases linked to large-scale environmental damage such as the water contamination caused by PFAS.
