EEOC Removes Conciliation Rule, Signaling Shift in Employment Regulation Landscape

The US Equal Employment Opportunity Commission (EEOC) has removed a rule from the Code of Federal Regulations that was introduced during the Trump administration and modified the conciliation process. The action comes nearly three years following Congress’ decision to repeal the rule.

Bloomberg Law reports that the EEOC made the announcement of the removal in the Federal Register. The rule, which had found favor amongst Republican lawmakers and business groups is no longer in effect.

The conciliation rule was initially enforced at the end of the Trump administration, requiring the EEOC to reveal more information upfront about its evaluative process to determine if a business had discriminated against a worker.

The rule repeal underscores the evolving landscape in employment regulation, prompting corporate legal professionals and businesses to stay abreast of such alterations to ensure compliance with employment laws.
