Electric car innovator Tesla is taking legal strides to halt an Equal Employment Opportunity Commission (EEOC) lawsuit charging them with racial discrimination. The lawsuit is characterized by Tesla as suffering from “factual vacuity,” essentially stringing together ungrounded stories to build its case.
In a recent filing made in the U.S. District Court for the Northern District of California, the automaker argued that the series of anecdotes presented by the EEOC are vague and lack sufficient evidential substance. This comes in addition to Tesla’s previous plea, in December, to stay the case — an action rooted in their contention that the EEOC bypassed a mandatory “conciliation” process.
The automaker’s argument includes the claim that the agency advanced with haste to court due to what Tesla labels as an “unseemly, toxic interagency competition” with the California Civil Rights Department, which had controversially tabled its own separate suit.
