Barclays Executive’s Whistleblower Suit Rejected by US Appeals Court

In a recent decision by the US Second Circuit Court of Appeals, the request of former Barclays Capital Inc. executive Brian La Belle to revive his whistleblower suit against the company was rejected. This was the latest development in a series of legal proceedings surrounding alleged violations of Barclays internal policies.

La Belle’s complaint hinged on his belief that Barclays had contravened its own internal regulations established to prevent fraud. However, the court rejected these allegations on the grounds that such internal policies were not mandated by the federal government and therefore, did not fall within the scope of protected whistleblower complaints. The court upheld a district court ruling indicating La Belle did not qualify as a protected whistleblower due to the nature of his complaint.

The court stated, “We see no reason to disturb the district court’s conclusion that La Belle failed to establish a whistleblower retaliation claim on this basis.”
