Renowned author E. Jean Carroll’s legal representation is urging the court to dismiss former President Donald Trump’s plea for an unsecured stay of the $83 million judgment passed against him earlier this year. Carroll’s defamation lawsuit resulted in the significant judgment wins against Trump.
Roberta Kaplan, Carroll’s attorney from Kaplan Hecker & Fink firm, argues that Trump is yet to provide the court with crucial information about his personal assets, which is an essential component in determining if any stay should be granted. Kaplan’s belief is based upon the lack of information regarding how certain future activities such as Trump’s ongoing legal proceedings and his upcoming election campaign will impact his overall financial standing.
Kaplan’s insistence that the court shouldn’t simply trust Trump’s plea without evidence is further elaborated upon in the original article available in the New York Law Journal. In essence, there needs to be sufficient proof to support the request, and currently, it appears that this evidence is lacking or insufficient according to Kaplan.
