This principle not only applies to employer-employee confines but also translates to law practices. Lawyers should not hesitate to share their billable hour rate with fellow practitioners.
The legal fee for the services of attorneys fluctuates widely, governed by circumstances such as the complexity of the matter, experience of the lawyer, location, and firm size. By considering these diverse factors, service charges from different lawyers for similar tasks can show stark contrast. My personal experience has shown me how a lawyer can end up charging significantly less than another for essentially the same service.
Creating a billable rate in an information vacuum is a challenging proposition. Online resources do provide guidance regarding the standard rates in the field, but their authenticity and reliability are often a concern. They could be outdated, or worse, not reflective of the actual practice on-ground.
Accurate information on billable rates is crucial, lacking which lawyers, notably those in their early practice years, might set their rates lower than the market – a sure-fire route to underpayment. The practice of gradually increasing the billable rates until client resistance is met is prevalent among new lawyers and is a time-consuming process. Moreover, renegotiating fee schedules with early clients who got accommodated at a lower rate often poses a significant challenge. Therefore, an upfront knowledge of the prevailing market rates will enable lawyers to charge with confidence and avoid potential client backlash.
Occasionally, when referring a client to another attorney, lawyers might inquire about billable rates. Discussion of specific client’s bill rates remains almost ubiquitously considered confidential, hence not disclosing it. However, offering the range of rates charged by the firm in general could serve as an effective strategy to maintain transparency without infringing upon client confidentiality.
While sharing billable hour rates, it’s crucial to remember that these rates shouldn’t be accepted as absolute facts. Some attorneys might inflate the numbers to appear more successful, and some might intentionally underestimate due to a lack of accurate market information. Still, sharing general rate ranges can aid attorneys in determining reasonable charges and prevent them from being underpaid due to an information deficit.
