U.S. District Judge Dan Polster on Monday decided that Motley Rice, one of the leading firms in opioid litigation, will remain involved in several key cases. Despite expressing his discomfort with the firm’s government client arrangements, Polster did not grant the requested disqualification motion put forth by pharmacy benefit manager OptumRx.
This motion came into light rather late in the process, raising questions about the timing and motivation behind it. OptumRx could have voiced its concerns as early as 2018, when Motley Rice member Joe Rice was assigned a significant role within the plaintiffs’ executive committee in the opioid multidistrict litigation. Considering this history, Judge Polster saw fit to reject the disqualification motion.
Notwithstanding, the Judge’s open reservations about Motley Rice’s engagements with government clients present an intriguing complexity to this ongoing litigation.
