Flushable Wipes Dispute Continues as Judge Denies Stop & Shop’s Motion to Dismiss

In a recent development from the federal court in Massachusetts, a motion to dismiss allegations against supermarket chain Stop & Shop by U.S. District Judge Indira Talwani has been denied. In the case, the plaintiff, Mark Schotte, accused the supermarket of deceptive advertising for labeling their cleansing wipes as “flushable”, in violation of trading and commercial practices.

Schotte asserted that, if Stop & Shop could assure the actual flushability of their wipes, he would consider repurchasing them, successfully arguing a likelihood of future injury that establishes standing for injunctive and declaratory relief. Judge Talwani validated this claim and thereby rejected Stop & Shop’s motion to dismiss the case.
