In a significant move, seven human rights lawyers filed a motion last Friday in the Berlin Administrative Court to halt Germany’s exports of arms to Israel. They posited that the German government has been aiding and abetting in the genocide of the Palestinian citizens living in Gaza by persistently supplying Israel with arms.
Backed by renowned non-governmental organizations (NGOs) such as the European Legal Support Center (ELSC), Palestine Institute for Public Diplomacy (PIPD), and Law for Palestine, the initiative was taken under the Justice and Accountability for Palestine Initiative.
Their demand for halting arms export is founded on numerous recent developments in global entities like the UN and the International Court of Justice (ICJ). As an illustration, the UN Human Rights Council adopted a resolution on Friday, calling upon all member states to cease the sales, transfer, and diversion of arms and other military apparatus to Israel, to prevent further breaches of international humanitarian law and human rights violations.
In addition, there are ongoing genocide cases against Israel pending in the ICJ, led by South Africa.
This demand follows mounting charges of international humanitarian law breaches against Israel as of recent. To exemplify, Human Rights Watch (HRW) released a report last Thursday alleging an Israeli airstrike on a civilian apartment building in late 2023 as an apparent war crime.
This isn’t the first instance when the aforementioned NGOs have tried prompting the German government into action concerning the ongoing Israel-Hamas war in Gaza. A month ago, these NGOs supported a criminal charge against German government officials for purportedly aiding and abetting genocide against the Palestinian people in Gaza by providing Israel with weapons and issuing related export permissions.
In response to the severe humanitarian situation in Gaza, the German Federal Foreign Office announced an escalation of their assistance with an additional 20 million euros this March.
