An Ohio appellate court has upheld a jury award exceeding $500,000 in a medical malpractice lawsuit, concluding that the lower court’s decision to permit the jury to consider certain pieces of evidence did not constitute a per se reversible error. The April 2 opinion, written by Judge Ginger S. Bock for the Ohio First District Court of Appeals, overruled assignments of error put forth by defendants Dr. Abubakar Atiq Durrani, the Center for Advanced Spine Technologies Inc. (CAST), the West Chester Hospital, and the University of Cincinnati (UC) Health.
In her opinion, Judge Bock stated, “After carefully reviewing the record, we hold that had the trial court precluded admission of the challenged aspects of the Durrani collage and any reference to Durrani’s license revocations and the other lawsuits, the jury likely would have reached the same verdict.” She went on to add, “Therefore, the trial court did not abuse its discretion by denying defendants’ motion for a new trial.”
