The law firm of Zimmerman Reed LLP recently triumphed over L’Occitane Inc in a federal district court dispute. The conflict centered around the claim, forwarded by L’Occitane that the law firm and its clients had visited the company’s site without valid authorization, infringing upon the Computer Fraud and Abuse Act.
L’Occitane initiated legal action on February 8, with the allegation that Zimmerman Reed was involved in a stratagem to elicit a settlement for L’Occitane’s use of analytics ‘cookies’. The motivation for this came from exploiting an arbitration clause within the terms and conditions as mentioned on L’Occitane’s site. This adoption of methodology by Zimmerman Reed triggered an appointed claim by L’Occitane that it infringed upon the Computer Fraud and Abuse Act, as well as other corresponding claims.
However, the litigation faced by Zimmerman Reed was dismissed as L’Occitane failed to substantiate a viable CFAA claim premised on the notion of revoking permission.
