Musk’s Lawyer Defends Conduct Amid Defamation Trial Deposition Drama

Elon Musk’s lawyer, Alex Spiro, responds to the lawyer who accused him of sabotaging Musk’s deposition in a Texas defamation case reports Bloomberg Law. The accusations are “a transparent attempt to sensationalize this case,” according to Alex Spiro, a partner at Quinn Emanuel Urquhart & Sullivan.

Spiro defends Musk in a lawsuit by Ben Brody, a California man alleging that Musk helped propagate a damaging conspiracy theory against him. Brody’s lawyer, Mark Bankston, earlier this month requested the judge in the case to sanction Spiro for his behavior during a virtual deposition of Musk. To this, Spiro responded with his own sanctions request, arguing that Bankston is disrupting the litigation “with unfounded accusations and publicity-minded barbs, exaggerations, and distortions.”

The lawyers on both sides described the March 27 Musk deposition as contentious and highly charged. Brody insisted that Spiro obstructed the deposition by ridiculing opposing counsel and interrupting the questioning. Spiro contended that he was “denigrated” for efficiently defending his client. John Bash and Emiliano Delgado, lawyers from Quinn Emanuel working on the case, wrote in a recent filing that “his instructions appropriately enforced the directive of this Court for a limited deposition.”

Brody is suing Musk over a Tweet implicating that Brody was an undercover law enforcement agent posing as a neo-Nazi street thug. Brody is seeking $1 million in damages for defamation, arguing that it led to a wave of harassment against him and his family.

In conclusion, this case underlines the increasing importance of conduct and procedural observance in high-profile defamation suits. It serves as a reminder for legal professionals to handle depositions with the utmost professional decorum, regardless of the complexities or tensions associated with a case.
