Kirkland & Ellis, however, defied these objections, standing firm on their stance that no conflict of interest exists in this case. The law firm insists that the parties who have articulated these concerns have failed to provide an adequate burden of proof to sustain their claim.
Deerfield Management Co., holding nearly 80% of Invitae’s 2028 senior secured notes, has been represented by Kirkland outside of Invitae’s bankruptcy proceedings. This fact has further deepened the scope of the ongoing debate over the presence of a potential conflict of interest.
