Supreme Court to Determine Plaintiff’s Right to Move Lawsuit Back to State Court

The U.S. Supreme Court is set to consider whether plaintiffs can amend their lawsuits to send them back to state court, following an initial successful transferal to meet before a federal judge.

The decision comes as a result of an appeal from food manufacturing giants Royal Canin and Purina, who are currently facing a class action lawsuit over purportedly misleading descriptions of their prescription pet food products. The plaintiffs claim these foods contain no medicine contrary to what the companies had advertised, warranting higher prices.

The crux of the issue before the justices is to determine whether removal of the federal question – a legal issue involving the U.S. Constitution or federal laws – from a complaint necessitates the litigation to be remanded to state court.
