Mental Health Accommodation Demands Surge, Corporations Face Legal Challenges

In the aftermath of the pandemic, a period in which remote working has become the new norm, employers are encountering a surge in accommodation requests on mental health grounds, a shift that poses significant legal and HR challenges for corporations.

Four years after a worldwide pivot to remote work environments brought on by COVID-19, large corporations are dealing with the implications of employees who are now voicing their mental health needs more openly.

According to a survey by Littler Mendelson, some 75 percent of the 400 in-house lawyers, executives, and HR professionals questioned reported an uptick in requests for leaves of absence or other accommodations due to mental health issues.

Certain comments bring home the crux of this emerging issue. “People are more willing to step up and say, ‘I’m a person who has this and this, and this is what it means to me'”, said Devjani Mishra, a Littler Mendelson shareholder. Leaving corporations to negotiate the complex landscape of providing more comprehensive mental health support, whilst ensuring they remain inside the boundaries of the legal regulations.
