Navigating Legalities: Archegos Defense Claims Pandemic Factors, Not Unlawful Actions, Behind Fund’s Collapse

The ongoing trial of Archegos Capital Management executives took an interesting turn as Barry Berke, a partner at Kramer Levin Naftalis & Frankel, defended his client, Sung Kook “Bill” Hwang. Speaking to a jury in the Southern District of New York, Berke asserted that Hwang did not violate any laws in the year before the dramatic collapse of his $36 billion fund in 2021.

Berke hinted towards the devastating pandemic, suggesting that many of the prosecution’s allegations, which they claim are indicative of improper conduct, were in reality, simply a result of the unparalleled circumstances brought about by the global health crisis.
