U.S. Senator Robert Menendez, D-New Jersey, currently standing trial for allegations of corruption, is adopting a risky strategy as reported by his legal representatives from Paul Hastings. The attorneys revealed that Menendez is going forth with the argument that he was uninformed of his wife’s actions.
However, this approach might not be as effective as hoped, according to Michael Weinstein, a white-collar defense expert at Cole Schotz. Weinstein stated, “You’re dealing with a very sophisticated political operative who’s been dealing in smoke and mirrors for 30, 40 years, and for him to now suggest that his wife was the culpable one, I think a juror is just going to pause and go ‘Really?’. You’re getting very close to turning off the jury at that point”.
Weinstein further remarked on the potential personalized impact on decision making from jurors. They may bring their own experiences and insights about the institution of marriage into the courtroom, which could raise doubts regarding the alleged lack of knowledge professed by Menendez about his wife’s conduct.
