Texas Law Firm Fights Back: Thomas J. Henry PLLC Denies Sexual Assault Retaliation Claims

Thomas J. Henry PLLC, the large Texas-based personal injury firm, has emphatically denied allegations of discrimination against a former employee. These allegations, brought forward by the former employee, revolve around a claim that she was demoted due to experiencing sexual assault by the firm’s CEO.

The former office manager, Clarissa Spear, has accused the CEO of the firm of drug-induced assault. In her retaliation claim, she alleges that after being assaulted, she was subsequently demoted.

The litigation has been documented in detail, revealing the legal complexities surrounding such sensitive cases. In this case, a particular point of disagreement is the nature of a protected class and whether this classification extends to victims of assault.

In response to these allegations, the firm filed a request on Monday with a federal judge in the US District Court for the Western District of Texas. They urge for the case to be completely dismissed based on the claim that the alleged victim of assault does not belong to a protected class nor partakes in a protected activity.

Spear did not submit gender-based claims since she could not provide evidence tying her demotion to her gender.

This legal case continues to unfold and pose important questions about the definition and expansion of the current understanding of “protected activity and class”.

The coverage of this case serves as a reminder for all legal professionals to adhere to the principles of ethical practice and maintain a zero-tolerance policy for any form of discrimination within the workplace.
