Sam Alito’s Upside-Down Flag Fiasco: Examining the Conflicting Explanations and Speculation

In the months following the infamous January 6 riot, an interesting detail emerged regarding Supreme Court Justice Sam Alito. It was observed that Alito’s residence was flying an upside-down United States flag, a mysterious spectacle as this particular display is commonly associated with a “Distress” signal or is often employed as a resistance symbol, particularly in connection with the “Stop the Steal” movement. However, when confronted about this, Justice Alito pointed to his wife as the one responsible for the flag display, offering no further clarifications.

Notably, Sam Alito has a military background and once served as a Captain in the U.S. Army’s Signal Corps – the very faction known for its handling of symbols and signals. His accountability in this matter became further convoluted when he faced scrutiny for a separate issue – his involvement in the Dobbs leak. Despite being linked to past leaks by a former right-wing activist, Alito denied any involvement. His engagement with a billionaire offering him free private plane rides also gained attention, an incident captured by Above the Law’s firsthand account from 2009.

As Alito’s own explanation proved inadequate, his defenders took the liberty to construct their own justifications as to why the flag at Alito’s residence was flown upside down. Among these was Edward Whelan’s theory. Whelan, who previously made headlines for using Zillow floorplans in an absurd attempt to debunk Christine Blasey Ford’s story during the Brett Kavanaugh hearings, now leaped to Alito’s defence. Whelan suggested that Alito and his wife possibly positioned the flag in distress as a retaliation against their anti-Trump neighbors, despite no evidence to back this theory.

Despite these efforts to provide other explanations and defend Alito, their arguments end up muddling the narrative rather than clarifying it. Not only do the arguments seem to undermine Alito’s own explanation, but they also operate on heavy speculation and assumptions, presenting a confusing defence front for Justice Alito.
