Legally practicing the law is a rewarding and often lucrative career, seen by many as a pinnacle achievement. Of course, this doesn’t necessarily mean all those within this field uphold the professional and ethical standards expected of them. A case surfacing earlier this year certainly underscored these occasional legal anomalies.
As per the information shared by the The Verge, a lawyer, who also chose to invest in a nightclub, found himself in a peculiar situation downright breaking ethical and professional boundaries involving his employees. His actions – and negligence thereof – resulted in the loss of his legal privilege.
The damning story was brought to light by the ABA Journal – a New York lawyer was disbarred following a series of allegations involving drug use and nonconsensual behaviour with his staff member(s).
In 2008, the lawyer Gaurav Malhotra, also known as Gary Malhotra, was hit with a criminal conviction for alleged misconduct in his nightclub. Reports suggest that he was accused of licking cocaine off a waitress, a serious violation of personal and professional boundaries. This became the anchor of one of the two ethics cases leading to him being officially disbarred earlier this year.
Concurrently, Malhotra’s indifferent approach towards a civil lawsuit thrown at him by the affected waitress culminated as the second ethics case. He failed to respond to the subpoenas, and moreover, didn’t even attempt to satisfy the $1 million default judgment filed against him by the waitress. A serious lapse in his legal responsibilities, it has to be said. When questioned about his negligence, he reportedly dismissed the allegations as ‘pretty silly’ and insinuated that the waitress was targeting him due to the environment he had cultivated.
Clearly, the argument lacked merit, providing no real defense for his ethical shortcomings. These actions, or lack thereof, raise compelling questions about his awareness and understanding of the law-making process – a trait which is expected from lawyers in any part of the world.
Malhotra’s actions serve as a stark reminder for professionals across industries, to maintain adequate ethical and professional conduct in all aspects of their life. Simply possessing knowledge isn’t enough, one must responsibly utilise and uphold it as well.
Despite the unsettling news of one less lawyer to consult in New York, one deceased member won’t shake the city’s robust legal community.
