The UN Special Rapporteur on Torture, Alice Jill Edwards, has called upon the Israeli government to investigate multiple allegations of torture and inhumane treatment of Palestinian detainees since the commencement of the Israel-Gaza conflict on October 7, 2023.
Alice Edwards underscored the necessity of humane treatment of detainees and strict adherence to international-recognized rights and humanitarian law, highlighting reports of abuse towards Palestinian prisoners since the October 7 attacks. According to her, it is mandatory for detainees to be provided with all protections under international human rights and humanitarian law irrespective of the circumstances surrounding their detention.
Various allegations such as beatings, extended periods of blindfolding and handcuffing, sleep deprivation, and threats of physical violence have been reported. Edwards brought forth concerns regarding the lack of accountability and transparency along with the exacerbation of overcrowding and the lowering of detention standards. All the torture claims, according to her, must be scrupulously investigated.
Edwards, in her capacity as an international law consultant, offered herself to assist Israel in scrutinizing the detention conditions through an official visit. The UN Special Rapporteur on Torture, a mechanism established by the UN Commission on Human Rights in 1985 and most recently extended in April 2023, investigates and reports on torture globally, regardless of a nation’s treaty status.
Meanwhile, ICC Prosecutor Karim A. A. Khan actively pursued arrest warrants against Israeli Prime Minister Benjamin Netanyahu, Defense Minister Yoav Gallant and senior Hamas leaders on charges of crimes against humanity and war crimes during the Israel-Hamas War. Charges against Netanyahu and Gallant include starvation and cruel treatment as warfare methods, intentional killing and directing attacks against civilians.
Hamas leaders Yahya Sinwar, Mohammed Deif, and Ismail Haniyeh have been charged with extermination, murder, hostage-taking, rape, sexual violence, torture and cruel treatment in the context of captivity, with specific allegations that hostages taken on October 7 were subjected to inhumane conditions such as torture. The examination of these requests is currently underway by the ICC.
