Coalition of Attorneys General Files Amicus Brief Supporting Title IX Protections for Transgender Students

“Enough is enough,” New Jersey Attorney General Matthew J. Platkin said in a statement regarding an amicus brief filed in support of Title IX’s recent changes. “We need policies that durably ensure fair and nondiscriminatory treatment of all students nationwide and do not change with the political winds.”

A coalition of 16 attorneys general, led by New Jersey, California and Pennsylvania, submitted a multistate amicus brief last week in several lawsuits aimed at blocking the Biden administration’s newly adopted Title IX rules. These regulations provide enhanced protections for transgender students, among other updates.

Following the Department of Education’s release of the final version of Title IX regulations on April 19, several challenges have been filed in federal courts in Alabama, Kentucky, Louisiana, and Texas. These lawsuits collectively contest the inclusion of gender identity in the definition of discrimination based on sex. Observers have noted that Alabama v. Cardona is expected to impact due process rights under the new Title IX rules, which are scheduled to take effect on August 1.
