Spain has experienced a rapid recent growth in litigation, particularly competition claims following on from regulatory findings of infringements. Trucks cartel claims continue to go through the regional Spanish courts, with many hundreds of separate judgments being issued to date. Following the ECJ’s February 2024 decision in relation to Scania (Case C‑251/22 P, Scania and Others v Commission), we expect to see more such claims being brought in Spain. Certain regional commercial court judges tend to be more claimant-friendly, particularly to individuals or small businesses, and often attach significant weight to claimants’ economic reports on damages quantum where such reports follow a credible and clear methodology.
