On June 7, 2024, US Supreme Court Justice Brett Kavanaugh declined to halt a federal appeals court ruling that compels Michigan to either retry or release Lafayette Upshaw, a man convicted of armed robbery. Kavanaugh’s decision came through an emergency request which he resolved without referring the matter to the other justices of the Supreme Court. Michigan sought the intervention of the court while it appeals the US Court of Appeals for the Sixth Circuit’s decision.
The Sixth Circuit’s ruling upheld a federal district court’s granting of habeas relief to Upshaw. The district court had mandated that the state either retry Upshaw or release him by September 3, following his argument against potentially biased jury selection affecting his original conviction.
