An appellate court in New Orleans has granted a stay on the U.S. Department of Transportation’s ban against transporting an explosive device utilized in oil and gas drilling. The decision comes as a temporary relief for MCR Oil Tools LLC, an Arlington, Texas-based oil field supplier whose main product is significantly impacted by the ban. The Fifth Circuit Court of Appeals pointed out that had the agency carefully reviewed the evidence, it would have realized its findings were overwhelmingly contradicted by that evidence. The court also noted the imminent economic harm MCR Oil Tools could face, as the product in question accounts for 75% of the company’s sales. The stay will remain in effect pending further review.
