Terri Lea argued that her Fifth Amendment rights were violated when the District allegedly used information from a background check to not only withdraw her job offer but also impede her future employment opportunities with the government. The appellate court upheld a lower court ruling, concluding that Lea was not entitled to additional due process beyond what she had already received.
Lea’s claims centered around the assertion that her constitutionally protected interest in reputation was compromised without sufficient procedural safeguards. However, the D.C. Circuit found that the protections provided were adequate and that the District’s actions did not warrant further due process. The initial decision was made by the district court, which Lea then appealed, stating that the court did not properly consider evidence which, according to her, indicated that the District has an automatic rejection policy for job candidates based on certain criteria from background checks.
