Federal Judge Joshua M. Kindred’s unexpected resignation from the District of Alaska has left the legal community in shock. According to the Judicial Council of the Ninth Circuit’s Complaint of Misconduct, the investigation revealed that Kindred created a hostile environment for his law clerks, exhibiting behavior that included discussing highly personal and unprofessional topics such as his romantic life and his colleagues’ personal lives. Additionally, the report documented instances of vulgar and inappropriate comments directed at his clerks, such as suggesting paying for a law clerk’s boyfriend’s tattoo and making lewd comments about their personal lives.
One notable incident involved Kindred receiving nude photographs from an Assistant United States Attorney and seeking advice from a law clerk on how to handle the situation. This compounded the discomfort in his chambers, with clerks feeling severely distressed and unsure how to react to his advances. Furthermore, allegations of sexual misconduct surfaced, including an event where Kindred allegedly kissed and later inappropriately touched a former clerk, a charge he denied despite being contradicted by text message evidence.
The gravity of these allegations prompted the Judicial Council to take decisive action. With the prospect of impeachment looming, Kindred opted to resign, effective July 8th, as detailed in his abrupt resignation news release.
