Tribunal Sentences Former Kosovo Liberation Army Member

The Trial Panel at the Kosovo tribunal in The Hague has sentenced former Kosovo Liberation Army (KLA) member Pjeter Shala to 18 years in prison. The verdict, delivered on Tuesday, found Shala guilty of multiple war crimes perpetrated during the 1998-1999 Kosovo War, including arbitrary detention, cruel treatment, torture, and murder.

According to the court, Shala was involved in the unlawful detention of several individuals, denying them the opportunity to legally challenge their detainment. Victims were subjected to cruel treatment and torture, with Shala failing to provide adequate food, water, sanitation, and medical care, exacerbating their mental and physical suffering. The court further established that Shala inflicted severe pain to extract information, punish, or intimidate the detainees, as well as discriminate against them on political grounds.

Shala’s actions included the excessive beating of a shot victim, contrary to medical advice, leading to the individual’s death within 24 hours. Shala was arrested in Belgium on March 16, 2021, and subsequently transferred to the Detention Unit of the Kosovo Specialist Chambers in The Hague on April 15, 2021. Despite pleading not guilty to all charges, the trial concluded with a guilty verdict.

The Kosovo Specialist Chambers and Specialist Prosecutor’s Office (SPO), a temporary body consisting of international staff, has jurisdiction over war crimes, crimes against humanity, and other offenses committed between January 1, 1998, and December 31, 2000. The chambers and SPO operate under the mandate granted by Article 162 of the Kosovo Constitution and the Law on Specialist Chambers and Specialist Prosecutor’s Office.
