The Gateway Pundit, a conservative website known for its controversial and often incendiary content, found itself at the center of several defamation lawsuits following false claims about the 2020 election.
Founded in 2004 by Jim Hoft, TGP generates approximately $3 million annually, largely through promoting dubious products and politically charged articles. The site has been an avid supporter of former President Donald Trump, spreading conspiracy theories and unfounded accusations of election fraud. This led to lawsuits from election personnel and executives from Dominion Voting Systems, who alleged defamation by TGP.
Seeking to avoid financial liability, Hoft filed for bankruptcy in Florida, arguing that TGP had business operations in the state. However, US Bankruptcy Judge Mindy Mora found several inconsistencies and irregularities in Hoft’s claims. These included conducting business without a local license and dubious financial transactions between Hoft and TGP.
Mora highlighted TGP’s substantial assets compared to its liabilities, suggesting that the bankruptcy filing was strategically motivated to evade state court liability. The court was particularly skeptical of Hoft’s insistence that concealing details about TGP’s writers was necessary to protect their identities, despite the site’s history of publishing personal information about plaintiffs.
Judge Mora’s ruling emphasized the lack of a valid reorganization purpose for TGP’s bankruptcy filing, concluding that the attempt was not made in good faith. This decision paves the way for TGP to address its defamation claims in state courts.
