Former US President Donald Trump’s campaign has formally challenged the legality of transferring $91.5 million from President Joe Biden’s reelection campaign to Vice President Kamala Harris’s presidential bid. A complaint was filed with the Federal Election Commission (FEC) on Tuesday by Trump’s campaign team, asserting that this transfer contravenes established campaign finance regulations.
This legal maneuver follows Biden’s recent decision to exit the 2024 presidential race. The complaint implicates Biden, Harris, and campaign treasurer Keana Spencer, accusing them of unlawfully substituting Harris’s name on campaign documentation without submitting a necessary statement of candidacy. Conversely, the Harris camp maintains that the campaign committees remain unchanged, only rebranded as Harris for President, Harris Victory Fund, and Harris Action Fund.
In a statement to the media, Trump campaign’s general counsel David Warrington accused the Biden-Harris team of a $91.5 million excessive campaign contribution, labeling the act as a flagrant violation of the Federal Election Campaign Act. The complaint further accuses the Harris campaign of submitting fraudulent documents to the FEC. The Trump campaign demands that the FEC launch an immediate enforcement action, enjoin the transfer, levy a civil penalty, and refer the issue to the Department of Justice for further criminal prosecution.
However, at least one FEC commissioner has suggested that Harris would have legal access to the campaign funds if she secures the Democratic presidential nomination. The campaign finance records confirm that funds had been approved for both Biden and Harris, potentially supporting the Harris campaign’s argument.
Election law expert Brendan Fischer shared on X (formerly Twitter) that Harris’s continual listing as the VP on committee filings since 2020 reflects a long-standing interpretation that incumbent presidents and vice presidents share an authorized committee throughout their term, indicating a precedence for such financial maneuvering.
Despite the heated allegations, legal experts in a CNN roundtable discussion opined that the resolution of this complaint would likely extend beyond the election, by which time the disputed funds might already have been expended.
