Ohio Supreme Court Rules in Favor of Restaurant in ‘Boneless’ Chicken Wing Liability Case

In recent developments, the Ohio Supreme Court has issued a 4-3 majority opinion denying liability claims against a restaurant and its suppliers over an incident involving a chicken wing described as “boneless.” The plaintiff, Michael Berkheimer, experienced significant injuries after ingesting a bone from the supposedly boneless chicken wing. Represented by Cincinnati attorney Robb S. Stokar of Stokar Law, Berkheimer sought compensation from REKM d/b/a Wings on Brookwood, food supplier GFS, and manufacturer Wayne Farms.

Stokar argued that the defendants should be held liable given the explicit marketing claims that the chicken wings were boneless. However, the court’s ruling not only denied Berkheimer the opportunity for a jury trial but also, according to Stokar, rendered the term “boneless” effectively meaningless.
