Omni Bridgeway Secures Victory To Transfer Apple Subpoena Battle to California Court

Litigation funder Omni Bridgeway has achieved a procedural victory in its ongoing battle with Apple Inc. over whether it should be compelled to disclose documents concerning a patent lawsuit, reportedly financed by Omni, against the tech giant. In a recent development, Omni was successful in its motion to transfer the case from the Delaware federal court, originally chosen by Apple for filing the subpoenas, to the Northern District of California. This particular court is also handling the underlying litigation between Apple and the Finnish patent owner involved.

Apple had opposed the transfer, arguing that Omni, being a Delaware corporation, should comply with Delaware’s jurisdiction. Furthermore, Apple suggested that moving the case could lead to unnecessary delays in the ongoing litigation. However, Chief Justice Colm F. Connolly granted Omni’s motion, citing a Federal Rule of Civil Procedure that allows for the transfer of a subpoena to the court where compliance is mandated. The legal battle over the document disclosure will now proceed in the Northern District of California.

Chief Justice Connolly emphasized the inefficiency of making a decision that could be subsequently nullified by the judge overseeing the main litigation. Known for his stringent stance on litigation finance transparency, particularly in patent cases, Connolly’s decision marks an important moment in this case. Details of Connolly’s commitment to transparency can be further explored here.

To provide context, Apple sought the court’s intervention in July to compel Omni to produce documents and answer queries related to the 2018 patent infringement lawsuit filed by MPH Technologies Oy, accusing Apple of infringing patents with its iMessage and FaceTime products. Apple alleges that Omni Bridgeway has backed MPH in the protracted legal battle, now spanning six years. The case in question is titled: In Re: Omni Bridgeway LLC, D. Del., 1:24-mc-330, 8/6/24. Further details on the subpoena transfer can be accessed here.
