RFK Jr. Challenges Ballot Exclusion in New York, Alleges Political Bias

Attorneys for independent presidential candidate Robert F. Kennedy Jr. have filed an appeal to be included on New York’s presidential ballot in the upcoming November 5 election. The appeal was lodged with the Appellate Division, Third Department in Albany, following a ruling by state Supreme Court Justice Christina Ryba. Justice Ryba had previously determined that Kennedy’s New York residency claim on his nominating petition contained a “false statement.”

The request for appeal, submitted by lawyers Howard E. Colton and Gary Donoyan, aims to challenge this ruling. Kennedy, alongside his running mate Nicole Shanahan, has characterized the lawsuit, initiated by a Democratic-aligned political action committee, and the trial court judge’s decision as politically motivated.
