Charlie Javice, the founder of the start-up Frank, which was acquired by JPMorgan Chase for $175 million, may use an advice-of-counsel defense in her fraud case, as suggested in a recent court filing. Javice, along with co-defendant Olivier Amer, “may present advice-of-counsel or presence-of-counsel evidence or arguments at trial,” according to the filing submitted on Friday.
The defendants allege that an unnamed individual provided legal advice pertaining to marketing and strategic decisions during the discussions with JPMorgan. The looming trial will likely see this defense strategy come into focus as Javice and Amer seek to substantiate their claims.
