Cooper ordered a permanent injunction in favor of CoStar Group Inc., safeguarding its subscription-based commercial real estate database. The decision concluded a breach-of-contract dispute where CoStar accused defendants, Leon Capital and Tiltbot, of unauthorized access and data downloads.
CoStar was awarded $60,000 in damages and an additional $40,000 in attorney fees. CoStar noted, “We are delighted that the Court is entering a permanent injunction prohibiting Leon Capital and Tiltbot from engaging in further wrongdoing, and ordering that they pay $10,000 each time they access the database and $50,000 for each record they download in violation of that injunction.” The case highlights the legal ramifications for entities that violate subscription agreements for proprietary data.
