Federal Judge in Florida Declares Qui Tam Provisions of False Claims Act Unconstitutional


In a ruling that has surprised many in the legal community, Judge Mizelle of the Middle District of Florida has deemed the False Claims Act’s qui tam provisions unconstitutional. “The False Claims Act has been around since the Civil War and has functioned in its current form for nearly 40 years,” said Ari Yampolsky, a partner at Whistleblower Partners. “Yesterday’s holding by Judge Mizelle in the Zafirov case is an aberration.”
