SmileDirectClub Founders Secure Loan Priority in Bankruptcy Court Ruling

In a recent ruling, SmileDirectClub Inc., the now-defunct dental alignment company, has been prohibited from altering the priority of loan repayments to its founders in favor of securing litigation funding. The judgment was rendered by Judge Christopher Lopez of the US Bankruptcy Court for the Southern District of Texas, who maintained that the repayment conditions established under the company’s bankruptcy loan must be honored. Consequently, the company’s founders must be reimbursed before any other parties partaking in the insolvency process.

This decision comes as a relief to the founders, who were concerned about the possibility of the court-appointed Chapter 7 trustee reprioritizing loan agreements to facilitate the acquisition of litigation funding. According to Judge Lopez, the existing repaying structure is steadfast due to being cemented by a court order, and any modifications that detract from this hierarchy are in violation of the terms.

Despite the bankruptcy court’s decision, SmileDirectClub still finds itself under financial duress, compounded by existing obligations which include a debt amounting to $28 million owed to its corporate insiders. The rulings exhibit the intricate balance needed in bankruptcy cases to protect the creditors’ interests while also managing the obligations to the company’s previous leaders, marking yet another chapter in the ongoing legal and financial discourse surrounding the SmileDirectClub case.
