Federal Judge Upholds Boston Police Verdict, Dismissing City’s Wrongful-Death Liability

In a recent ruling, U.S. District Judge Richard G. Stearns declined the request for a new trial from Goodwin after a jury sided with the Boston Police in a wrongful-death lawsuit. The case involved allegations by Goodwin that the officers had violated the constitutional rights of Stilphen, leading to his wrongful death. However, the jury found no such violation, leading Judge Stearns to dismiss the Monell claim against the city.

Judge Stearns noted that because the jury determined the officers did not infringe upon Stilphen’s constitutional rights, the Section 1983 claim, which depends on such a violation, could not be sustained against the city.
