ICJ Confirms Jurisdiction in Armenia and Azerbaijan Racial Dispute Case

The International Court of Justice (ICJ) has affirmed its jurisdiction to adjudicate on the racial discrimination allegations that Armenia and Azerbaijan have leveled against each other. These claims are processed under the framework of the International Convention on the Elimination of All Forms of Racial Discrimination. Armenia accuses Azerbaijan of committing serious human rights violations, including murder, torture, arbitrary detention, and enforced disappearances. Conversely, Azerbaijan alleges that Armenia has engaged in ethnic cleansing activities.

The ICJ determined that Armenia had fulfilled its obligations by attempting to negotiate a resolution, but these negotiations reached an impasse. The court found that a mutual resolution was not feasible, fulfilling the precondition under Article 22 of the convention for adjudicating such disputes at the ICJ.

Regarding Azerbaijan’s claims, the court concurred that evidence regarding Armenia’s alleged use of landmines and traps could imply practices of ethnic cleansing. Nevertheless, claims concerning actions before the convention’s effective date in Azerbaijan, September 15, 1996, were excluded from the case. The court noted that these obligations towards Azerbaijan began only after this date, despite Armenia’s earlier accession to the convention in 1993.

Moreover, allegations against Armenia relating to environmental damage were dismissed as they were seen as commercially driven or due to neglect rather than racially motivated discriminatory practices.

The backdrop of these legal proceedings traces back to complex sovereignty disputes over the region known as Nagorno-Karabakh by Armenia and Garabagh by Azerbaijan.
